I. GENERAL TERMS / REWARD TERMS
A. Membership requirements:
1. Users must be 18 years or older OR 13 years or older with parental permission. A user under 18 certifies that a parent has given permission by checking the box that corresponds to "I Agree."
2. Users must provide valid and truthful information during all stages of membership at Free Points Now .
3. Territories and APOs/FPOs are not eligible.
4. Users must not create more than one account per person, nor may they create more than one account per household.
5. Users must not create more than one account per computer.
6. Users must log in and use Free Points Now on their own personal computer only. The use of a Free Points Now account on a public or shared computer is grounds for disqualification.
7. Users must not use a proxy or otherwise attempt to mask or reroute their connection.
B. Disqualification. A user's account may be disqualified and his or her earnings forfeit in, but not limited to, the following cases:
1. He/she violates any of the terms set forth in these Terms of Service,
2. He/she posts his or her referral link where it is unwelcome (e.g., "spamming"),
3. He/she attempts to exploit any vulnerability on Free Points Now (e.g., "hacking"),
4. He/she is determined by Free Points Now , in its sole discretion, to be detrimental to the stability of this site or this site's relationship with its advertisers.
5. He/she posts instructions for canceling any offer, a walkthrough, or any other type of tutorial or suggestion on a website. This includes but is not limited to: instructions on completing a specific offer, suggesting an offer based solely on its payout, or including cancellation web addresses or telephone numbers.
6. He/she provides fake, invalid, or information that does not reflect themselves on an offer. Each user must use his/her VALID information on every offer completed. A user may not create an email address or voicemail box for the sole purpose of completing offers.
C. Cancellation:
1. There is no function available for canceling accounts. Users wishing to cancel their account may simply cease to log in.
2. Accounts not used or logged into for a period of 120 days will be deleted automatically.
D. Transfer:
1. Accounts may not be transferred, exchanged, sold, or otherwise change ownership under any circumstances, except by Free Points Now .
II. RESERVED RIGHTS
A. Reserved Rights. Free Points Now reserves the following rights:
1. Free Points Now reserves the right to deny payment for any legitimate reason.
2. Free Points Now reserves the right to disable any account for any reason.
3. Free Points Now will report fraudulent activities to the proper authorities.
4. Free Points Now reserves the right to update these terms at any time. Any such update will be posted to this page.
5. Free Points Now reserves the right to terminate this agreement at any time.
III. OFFERS
A. Offer Completion.
1. Free Points Now is solely responsible for offer crediting. Please do not contact offer providers (advertisers) regarding offer credit.
2. Users may only complete an offer if they have never completed it previously, whether on this site or another.
3. While we strive for accuracy, typographical errors do occur. Free Points Now is not responsible for typographical errors on the offer pages.
4. Free Points Now reserves the right to adjust commission rates at any time for any reason.
5. Users must try only those offers in which they have a legitimate interest. If a user is found, in Free Points Now 's sole discretion, to be in violation of this provision, his/her earnings will be forfeit and his/her account disqualified.
6. Users must provide valid information when signing up for offers. Falsifying information for offers is grounds for account or offer credit disqualification.
7. Free Points Now uses industry-standard tracking software, but occasionally offers fail to credit. Free Points Now does not guarantee payments for offers which fail to track and credit.
B. Offer Terms:
1. Free Points Now is not responsible for the terms, conditions, or any other contractual agreement of any offers listed on this site as we have no control over them. We strongly suggest that users carefully and completely read all the terms and conditions associated with each offer before completing it.
2. If a sponsor reports you as using a stolen or fraudulent credit card, your account will be terminated and all points will be forfeited If an advertiser reports to us that you have provided them fake or falsified information we will chargeback your account double, and may terminated your account at our sole choice.
3. The use of a Prepaid Credit Card and/or Debit Card is strictly prohibited on our site. If you are found to be using such a card from our sponsors you will NOT BE PAID, and your account WILL BE BANNED.
IV. PAYMENTS ("Cashing out / Prize Requests")
A. Disbursement.
1. All payment of rewards is carried out by Free Points Now and advertisers should not be contacted regarding this matter. Free Points Now disburses payment for the previous month on or around the 20th of each month. If the user chooses to receive a check, he/she agrees to allow up to 10 additional business days for checks to be delivered by the United States Postal Service. Electronic payments are generally fulfilled by the 20th but may be delayed due to circumstances outside Free Points Now 's control.
2. Once an offer or bonus has posted to a user's account, he/she must "cashout" within 180 days. After 180 days, offers and bonuses expire and are no longer eligible for payment. Sign up bonuses expire after 30 days. If you do not use your sign up bonus within 30 days your sign up bonus may be removed.
B. Substitution.
1. No substitution, assignment or transfer of cashouts is permitted, except by Free Points Now . Free Points Now will make reasonable efforts to alert the user when a substitution occurs.
C. PayPal Requirements. The PayPal cashout method has the following stipulations:
1. Multiple Free Points Now users may not share a single PayPal account.
2. There must be an active PayPal account at the payment email address.
3. D. Prize shipments:
1. If you requested a prize/cash-out and it was one we were required to ship we are not responsible for it once it hits the USPS.
2. We ship most items first class mail. If a tracking number is available it will be mailed to you at the time of us printing the mailing label. (if we are directly sending it you). If the item is coming from a vendor the order confirmation number will be provided to you in case for some reason it does not arrive.
3. Tangible prizes we can not be held accountable for once they have been shipped. The post office from time to time may lose a package or envelope. Sadly, since most items are not insured we are unable to do anything if this case may arise. You are instructed to contact your local postal inspector if this case arises.
V. WORD OF MOUTH
A. Definitions:
1. A "Referral" is defined as: a user who signs up for Free Points Now at another user's direction or suggestion, whether via a referral link or unreferred.
2. "Unique and valid" is defined as residing in a different household and using a different internet connection.
B. Conditions:
1. Referrals must be unique and valid users.
2. You may not sign up "on behalf" of another user.
C. Falsification of Referrals:
1. Any user falsifying Referrals may be subject to any or all of the following:
a. account termination.
b. loss of earnings.
c. legal action.
D. Walk-throughs:
1. Users may not instruct their Referrals, or any other user, as to which offers to complete, nor assist them in completing offers. This is considered a "walk-through" and is strictly forbidden. Additionally, a user may not sign up for an offer "on behalf" of another user.
E. Responsibility.
1. Users are responsible for the validity and eligibility of their Referrals. Users who generate large numbers of fraudulent Referrals, regardless of the method or intentions, will be subject to account termination and loss of earnings.
VI. INDEMNIFICATION
A. Liability:
1. You agree to hold Free Points Now completely without liability or fault in the course of any court proceedings ("hold harmless").
B. Unenforceability:
1. If any provision of this agreement shall be held or made invalid or unenforceable by a court decision, statute, rule or otherwise, the remaining provisions of this agreement shall not be affected thereby.
VII. ADDITIONAL INFORMATION
A. Time zone. All dates and times given are U.S. Eastern Time.
B. Forum. Any dispute under this agreement must be settled under the laws of Florida. Any litigation relating to this document must be brought in the federal or state courts located in Pasco County, FL, our place of business.
C. We will not be held responsible for mis-configured browsers or computers that block or do not allow tracking cookies. Before using our site you agree that you have checked that your computer does allow session cookies.
VII. DOMAIN NAMES AND HOSTING
A. The use of services from Free Points Now [hereafter referred to as " Free Points Now "] constitutes agreement to these terms.
1. Free Points Now has a Zero Tolerance policy for those who use our domains for the purpose of abuse. If we receive reports from our domain register that any such domain has been used to Spam, commit fraud, or anything else that maybe considered illegal in the United States of America without any second thought we will suspend your domain and/or cancel it with out notice.
2. Free Points Now will assume no liability for anyone who uses our system nor will we take liability for those who register a domain from us and use it for illegal purposes. Free Points Now assumes zero liability for anything related to the domain we may register for you. We pass all liability on to the domain registrant.
3. If it comes to the attention that there is invalid information in the whois for your domain, or it is not correct, we may be forced to suspend the domain until the proper information can be obtained so that we can stay current with Icann Rules.
4. Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
5. Free Points Now will register all domains in the name of their members. The domain is 100% the members.
6. Hosting of adult content is prohibited.
7. Free Points Now will not host content that is considered a conflict of interest.
8. The hosting of a proxy server is prohibited.
9. If the hosting of your site effects others on our servers, your site will be suspended and pending review maybe terminated if it violates other policies herein.
B. CUSTOMER DOMAIN REGISTRATION PRODUCT AGREEMENT EXTENSION
1. Free Points Now (hereinafter referred to as "Parent") AND you (hereinafter referred to as "Customer") HAVE entered into a Customer Master Agreement ("Agreement") effective from October 12, 2006 of which this "Domain Registration Product Agreement Extension" is a part.
WHEREAS, Parent is authorized to provide Internet registration and management services for second-level domain names within .COM, .NET, .ORG, .BIZ, .INFO, .NAME and .US top level domains and .NAME Defensive Registrations and .NAME Mail Forwards;
WHEREAS, the Customer wishes to purchase Registration and/or Management and/or Renewal and/or Transfer for .com or .net or .org or .info or .biz or .name or .us top level domains or .NAME Defensive Registrations or .NAME Mail Forwards through Parent;
NOW, THEREFORE, for and in consideration of the mutual promises, benefits and covenants contained herein and for other good and valuable consideration, the receipt, adequacy and sufficiency of which are hereby acknowledged, Parent and the Customer, intending to be legally bound, hereby agree as follows:
a. DEFINITIONS:
i. "TLD" refers to .com, .net, .org, .info, .biz, .us, .name
ii. "gTLD" refers to .com, .net, .org, .info, .name and .biz
iii. "Domain Order" refers to an Order fulfilled by the Customer through the Parent under this Domain Registration Product Agreement Extension
iv. "Registrant" refers to the registrant/owner of a Domain Order as in the OrderBox Database.
v. "Registrar" refers to the Registrar of a Domain Order as in the OrderBox Database and/or shown in the Whois Record;
vi. Registry Operator refers to the Organisation/Entity that maintains the registry of a TLD of a Domain Order;
vii. "Whois Record" refers to the collection of all data elements of the Domain Order, specifically its Registrant Contact Information, Administrative Contact Information, Technical Contact Information, Billing Contact Information, Nameservers if any, its Creation and Expiry dates, its Registrar and its current Status in the Registry;
b. OBLIGATIONS OF THE CUSTOMER:
i. The Customer must ensure that the Registrant of each Domain Order must agree to be bound by the terms and conditions laid out by the Registrar of the Domain Name during the term of the Domain Order.
ii. The Customer must familiarize himself with such terms.
iii. The Customer acknowledges that the Registrar has various rights and powers as mentioned in the Registrar's terms and conditions.
iv. Parent is not liable for any action taken by Registrar pursuant to the Registrar's terms and conditions.
v. The Customer acknowledges and agrees that the Customer shall indemnify Parent of, and shall be responsible for any liability resulting from Registrants' noncompliance with such terms and conditions.
c. RIGHTS OF PARENT:
i. Parent and Service Providers, in their sole discretion, expressly reserve the right to freeze, delete, suspend, deny, cancel, modify, take ownership of or transfer any Domain Order, in order to comply with any applicable Dispute policies, requests of law enforcement, or in compliance with any Court Orders, or if Parent or Service Providers in their sole discretion determine that the information associated with the Domain Order is inaccurate, or has been tampered with, or has been modified without authorization, or if Parent or Service Providers in their sole discretion determine that the Domain Order ownership should belong to another entity, or if Customer/Customer/Registrant does not comply with any applicable terms and conditions, standards, policies, procedures, and practices laid down by Parent, Service Providers, ICANN, the Registrar and the Registry Operator.
ii. The Customer agrees that Parent and Service Providers, and the contractors, employees, directors, officers, representatives, agents and affiliates, of Parent and Service Providers, are not liable for loss or damages that may result from any of the above
d. SURVIVAL:
i. In the event of termination of this Product Agreement Extension for any reason, Sections 2 and 3 shall survive
e. Hosting can not be used to host anything illegal, adult related, IRC or Hacking Related.
VII. CUSTOM ORDERS
A. If you request an item from our listing, and choose to order one that is in the used condition and it arrives in an un-usable condition, we will not accept returns on it nor facilite exchanges on it.
VIII. MANUAL CREDIT
A. We do not offer any form of manual credits. Due to Fraud and abuse most advertisers will not honor a credit. If your offer did not track properly this is due to fault of your computer not handling tracking cookies properly. We suggest marking the offer as available than re-marking it as completed a second time. Some times an offer does not import within 7 days which results in it getting denied by mistake.
IX. Recommendations
A. We highly recommend before using our site you clear your cookies, set your browser to allow all cookies, and make sure if you have any anti-spy ware program it is not blocking cookies. Many anti-spy ware programs give you the false sense of protection by deleting "tracking" cookies as they come in, but in fact are protecting you against nothing. IN NO EVENT SHALL Free Points Now , A FLORIDA CORPORATION, BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION OR LOSS OF BUSINESS INFORMATION), ARISING OUT OF OR IN CONNECTION WITH THE AVAILABILITY, PERFORMANCE OR USE OF THE INFORMATION CONTAINED ON THIS WEBSITE, EVEN IF Free Points Now HAS BEEN ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES.
